Terms and conditions of sale

This is a courtesy translation. The French version is the only one that binds the parties, and French law governs the contract. Where the two differ, the French text prevails. Read the French version.

1. Purpose

The service consists of searching the Dun & Bradstreet database for the D-U-N-S number of the entity designated by the customer, and communicating the result of that search. It does not in any way constitute obtaining, creating or assigning a number, which are prerogatives belonging to Dun & Bradstreet alone.

2. No guarantee of result

Not every company holds a D-U-N-S number. The provider is bound by an obligation of means and guarantees no result. The search may legitimately conclude that the number sought does not exist, without this amounting to non-performance.

3. Price and taxes

The price is €24.99 excl. tax. Value added tax is added to it: it is calculated at the time of payment according to the customer's country, under the applicable rules. The total amount, taxes included, is displayed before the payment is confirmed, and it is that amount which is charged.

4. Delivery time

The result is communicated within 1 hour, 24 hours a day and 7 days a week, from the confirmation of payment by the payment provider. This period is suspended for any time during which the provider is awaiting information requested from the customer, and resumes upon receipt of the reply.

5. Refunds

The refund is full and automatic where the search concludes that no D-U-N-S number exists for the designated entity, and also where the file is closed for want of a reply from the customer to a request for information within 7 days. The refund is made to the payment method used when ordering.

6. Limitation of liability

The provider's liability is limited to the amount of the order, namely €24.99 excl. tax, whatever the basis of the claim. The provider cannot be held liable for decisions taken by third parties, in particular Apple, Google or any principal, in the light of the information communicated.

7. Accuracy of the information provided

The customer warrants that they are authorised to act on behalf of the designated entity and is answerable for the accuracy of the information they enter. A search carried out on erroneous information remains payable. The provider flags any manifest inconsistency to the customer before concluding.

8. Delivery

The result is communicated to the email address entered when ordering, and to that address alone. No forwarding to another address is carried out, including at the customer's request, save on written request from the original address.

9. Right of withdrawal

As the service begins on payment, the customer expressly requests its immediate performance before paying. Where the customer acts as a consumer, they thereby expressly waive their right of withdrawal, in accordance with articles L221-25 and L221-28 of the French Consumer Code. That request and, where applicable, that waiver are obtained before payment by a tick box that is never pre-ticked, without which payment cannot be started, and which constitutes acceptance of these terms. The right of withdrawal does not apply to a business customer acting in the course of their activity.

10. Personal data

The processing of the data provided is described in the privacy policy, accessible from every page of the site.

11. Governing law and disputes

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action, by writing to contact@duns.app. Failing agreement, a consumer customer may refer the matter free of charge to a consumer mediator, whose details appear in the legal notice.
